Privacy Policy

Speakable is a comprehensive online language platform designed to help schools and districts teach language curriculum, particularly speaking. The platform includes web-based content, teacher tools, and resources. We refer to these products as the “Website” or the “Services.”

Please read this Privacy Policy carefully before accessing or using the Website.

1. Overview

This Privacy Policy (the “Policy”) explains what data we collect, why we collect it, and what we do with it. It applies to students, teachers, and anyone else who uses our Website.

This Policy applies to information that we collect when you use our Services online. It does not apply to information we collect offline or information you provide to third parties, including through any application or content that may link to or be accessible from the Website.

We use the term “Personal Information” to refer to information that identifies you as an individual, such as your name or email address.

By using the Services, you accept and agree to this Privacy Policy. Your use of the Services is also governed by our Terms of Use. You should read both documents together.

2. Information We Collect and Why

We aim to collect only the information necessary to provide a strong learning and teaching experience. We receive and store information you knowingly enter into the Services. We also collect certain information automatically.

2.1 Account Information

When you create an account as a student or teacher, you enter your name, username, and email address.

Students in schools enter a class code provided by their teacher to link their account to their classroom and school.

Teachers provide information about their school so we can verify their status as an educator.

2.2 Technical Data

As you use our Website, we may use automatic data collection technologies to collect information about your equipment, browsing actions, and usage patterns.

This may include:

  • Details of your visits, including traffic data, location data, logs, and other communication data
  • Information about your computer and internet connection, including IP address, operating system, and browser type

The information collected automatically is statistical and does not include Personal Information. It helps us:

  • Estimate audience size and usage patterns
  • Monitor site performance and uptime
  • Resolve technical issues
  • Store preferences and customize the Website
  • Recognize returning users

We may use technologies such as cookies and web beacons for this purpose. You may disable cookies in your browser settings, but some Website features may not function properly if you do.

2.3 Coursework and Grading Data

If you are a student, we collect information about your practice habits, including:

  • Pronunciation success and failure
  • Multiple-choice results
  • Typing performance
  • Listening performance
  • Number of attempts
  • Time spent

This information allows us to provide the Services, improve coursework, and enable teachers to assess and monitor student progress.

2.4 Artificial Intelligence and Automated Processing

Speakable uses automated technologies, including artificial intelligence and machine learning systems, to support features such as automated grading and feedback. This processing is performed solely to provide educational functionality within the Services.

Speakable does not use Student Data to train publicly available artificial intelligence models and does not permit third-party AI providers to use Student Data for independent model training or unrelated commercial purposes.

2.5 Student Content and Uploaded Files

If you are logged into your Speakable account, we save your progress so that teachers and students can revisit work and continue lessons.

Students and teachers may upload content through the Website. Content uploaded as part of a lesson or assignment is stored on the Website.

2.6 Student Data Ownership

Speakable does not claim ownership of Student Data. Student Data remains the property of the student, school, district, or educational institution that provided the data, in accordance with applicable law and institutional agreements.

Speakable processes Student Data solely to provide and improve the Services.

2.7 Voice Recordings and Biometric Data

Speakable may process student voice recordings for speaking assignments and feedback.

Speakable does not use voice recordings to identify individuals through biometric recognition technologies and does not create biometric identifiers or biometric profiles from student recordings.

3. How We Use and Share Information

We do not sell or rent Personal Information to any third party for advertising or marketing. We do not allow advertising on our Services.

Speakable does not sell Student Data, use Student Data for targeted advertising, or build commercial profiles of students unrelated to educational purposes.

3.1 Access Controls

We restrict access to your information to employees, contractors, and agents who need it to provide the Services. These individuals are subject to strict contractual security and confidentiality obligations.

3.2 Subprocessors and Service Providers

Speakable uses trusted third-party service providers to support operations, including:

  • Cloud hosting
  • Data storage
  • Payment processing
  • Customer support tools
  • Application monitoring
  • Email communications
  • Security services

Service providers are required to maintain confidentiality and process data only to provide services to Speakable. They are not permitted to sell Student Data or use it for marketing purposes.

A current list of subprocessors is available upon request.

3.3 Legal Disclosures and Business Transfers

We may disclose information to a buyer or successor in the event of a merger or acquisition. This Privacy Policy will continue to apply unless you consent to a new policy.

We may also disclose Personal Information:

  • To comply with court orders or legal process
  • As required under the Student Data Privacy Addendum for K–12 customers
  • To ensure site security or enforce agreements
  • To protect rights, property, or safety
  • To state or local educational agencies for K–12 school purposes

We may disclose aggregated, non-identifiable information without restriction.

4. Data Retention and Deletion

Users may update or remove Personal Information via the Account Settings page.

Teachers, students, and parents where applicable may request deletion by emailing andrew@speakableapp.com.

Deleted information is removed from active databases. Archived copies may be retained as required by law or legitimate business purposes.

Speakable generally deletes Personal Information four years after a user’s last login.

For K–12 customers, Student Data will be deleted within 60 days of written request or contract termination, as described in the Student Data Privacy Addendum.

Upon expiration or termination of a school or district agreement, Speakable deletes Student Data in accordance with contractual obligations and applicable law. Backup systems may temporarily retain encrypted data consistent with disaster recovery practices.

4.1 Parent and Student Rights

Parents and eligible students may request access to, correction of, or deletion of Student Data through the student’s school or district.

Speakable works with educational institutions to facilitate these requests in accordance with FERPA and other applicable laws.

5. Data Security

We implement reasonable measures designed to protect information from accidental loss and unauthorized access.

Payment information is transmitted using HTTPS encryption and processed through Stripe. Speakable does not directly collect or store payment instruments.

Speakable:

  • Encrypts data in transit and at rest
  • Implements role-based access controls
  • Monitors systems for unauthorized access
  • Requires multi-factor authentication for personnel accessing production systems

If a data breach affects your information, we will comply with applicable notification requirements.

6. Data Hosting and International Transfers

Speakable stores and processes data using cloud infrastructure located in the United States.

Speakable does not host Student Data outside of the United States.

7. Children Under 13 (COPPA)

COPPA requires parental consent before collecting Personal Information from children under 13.

We rely on schools, districts, and teachers to obtain appropriate parental consent when students use the Services in an educational context.

If we learn that Personal Information has been collected from a child under 13 without proper consent, we will delete it as quickly as possible.

8. Student Data Privacy Addendum (K–12 Institutions)

For K–12 Educational Institutions using Speakable, additional protections apply as described in our Student Data Privacy Addendum. This Addendum supplements this Privacy Policy and outlines Speakable’s responsibilities under FERPA, COPPA, and applicable state student data privacy laws.

When Speakable is used by schools or districts, we act as a School Official with a legitimate educational interest under FERPA. We process Student Data solely on behalf of and under the direction of the educational institution and only for authorized educational purposes consistent with contractual obligations.

Under the Student Data Privacy Addendum:

  • Student Data remains the property of the school, district, or educational institution
  • Speakable uses Student Data only to provide, maintain, and improve the Services
  • Speakable implements administrative, technical, and physical safeguards
  • Speakable supports access, correction, and deletion rights consistent with law
  • Speakable provides breach notification as required by law
  • Speakable does not use Student Data for targeted advertising or commercial exploitation
  • Speakable does not redisclose Student Data except as permitted by law or authorized by the educational institution

Where conflicts exist regarding Student Data, the Student Data Privacy Addendum governs over this Privacy Policy.

9. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Material changes will be posted on this page and, where appropriate, emailed to the address associated with your account.
